Though rarely enforced, the state Senate today decided to keep the law that makes adultery a crime in New Hampshire.
Senators on a voice vote refused to agree to the law's repeal as contained in HB 1402.
The House had approved of the repeal. The Senate's Judiciary Committee had recommended against repeal.
It was argued said that repealing the law could cause problems with civil divorce laws.
Others countered that the law should be repealed since it isn't enforced and would only cause emotional harm if it is enforced.
Offenders of the law face a $1,200 fine. It used to be that offenders had to stand on the gallows for an hour with a noose around their necks.
