"Live Free or Die" doesn't apply to drinking games?

If state Sen. Amanda Merrill has her way, drinking games in bars will be illegal.

SB 251 prohibits "certain games and contests in establishments licensed by the liquor commission."

Merrill's goal is to curb excessive consumption of alcohol... by consenting adults. While I am opposed to this bill in its entirety, I understand the concerns about establishment sponsored drinking games.

Promotions in college bars have the potential to get out of hand. But this bill's tentacles not only reach bar owners and promoters, it also impacts patrons. What about the four gentlemen who wager a beer or shot during a game of pool? Such action falls under this legislation.

I. No licensee, or employee or agent of a licensee, shall sponsor, permit, or encourage, on the licensed premises, any game or contest in which:

(a) A patron is encouraged or required to consume alcohol as a condition of participation in the game or contest;

(b) A patron is required to consume alcohol as a consequence or result of participation in the game or contest;

(c) Alcohol is awarded as a prize for participation in the game or contest; or

(d) The game or contest encourages excess consumption of alcohol.

Violators are subject to a minimum fine of $300 for a first offense and a minimum of $600 for a second or subsequent offense.

Who is going to police the patrons? Will staff be required to police patrons?

During a public hearing earlier this week. State Sen. Andy Sanborn (R-Henniker) said the state already has laws prohibiting excessive alcohol consumption.

It's my opinion that SB 251 is unnecessary and a blatant attempt at over-legislation. If I'm wrong, I'll buy you a drink.
